These Terms of Use ("Terms") govern your access to and use of the QCrypton website at www.qcrypton.com (the "Site"), including any services, features, content, and applications offered by QCrypton ("we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms.

1. Modification

10. Warranty Disclaimers

10.1 As-Is Basis

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2 No Guarantee

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.3 Cryptographic Disclaimer

WHILE QCRYPTON IMPLEMENTS POST-QUANTUM CRYPTOGRAPHIC ALGORITHMS IN ACCORDANCE WITH PUBLISHED STANDARDS (FIPS 203, 204, 205; RFC 9180), WE MAKE NO WARRANTY THAT SUCH IMPLEMENTATIONS WILL PROTECT AGAINST ALL FUTURE QUANTUM COMPUTING THREATS OR CRYPTANALYTIC ADVANCES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QCRYPTON, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO QCRYPTON IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) FIVE US DOLLARS ($5.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless QCrypton and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Site or violation of these Terms.

13. Term and Termination

These Terms remain in effect while you use the Site. We may suspend or terminate your access to the Site at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Delaware.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and QCrypton concerning the Site and supersede all prior agreements and understandings.
